Use of Subrate

Description of Service
Subrate provides a platform that allows users to access and use certain services, including but not limited to tracking and measuring app traffic, collecting data directly from users, and accessing the photo gallery. The services offered by Subrate may change from time to time without notice to you. Subrate will not require users to engage in any marketing-oriented tasks.
User Accounts
To use Subrate, you must create an account by providing your name, email, and password. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
User Data
Subrate collects data directly from users, including but not limited to name, email, and password. Subrate uses tracking solutions to measure app traffic and may use local storage and sessions to collect data. By using Subrate, you agree to the collection, use, and disclosure of your data as set forth in these Terms and Conditions and the Subrate Privacy Policy.
Intellectual Property
The content, organization, graphics, design, and other matters related to Subrate are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of Subrate is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through Subrate. The posting of information or materials on Subrate does not constitute a waiver of any right in such information and materials.

SUBRATE IS PROVIDED BY HMEDIA LLC ON AN “AS IS” AND “AS AVAILABLE” BASIS. HMEDIA LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF SUBRATE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON SUBRATE. YOU EXPRESSLY AGREE THAT YOUR USE OF SUBRATE IS AT YOUR SOLE RISK.
Limitation of Liability
HMEDIA LLC WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OF SUBRATE.
Changes to Terms and Conditions
HMEDIA LLC reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time without prior notice to you. Changes to these Terms and Conditions will be effective when posted on Subrate. Your continued use of Subrate following the posting of changes to these Terms and Conditions means you accept the changes.
